1. Agreement to Terms

By accessing our website and using our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you are prohibited from using our site or engaging our services.

2. Scope of Services

Blue-CollarDigitals provides software development and operational systems consulting services, specializing in custom booking platforms, online ordering applications, and integrations for local service businesses. Consultation requests submitted through this website represent inquiries and do not constitute a formal contract or binding agreement to perform custom development. For clients under a WAaaS subscription, this includes ongoing hosting, security maintenance, and ongoing feature development for the duration of the active subscription.

3. Subscription Billing & Cancellation (WAaaS Clients)

WAaaS engagements require a one-time setup fee followed by recurring monthly billing. By subscribing, you agree to:

• A minimum initial term of 12 months from the subscription start date, billed monthly.
• After the 12-month minimum term, the subscription continues on a month-to-month basis and may be cancelled at any time with written notice to jerome@blue-collardigitals.ca.
• Cancellation takes effect at the end of the current billing cycle; no partial-month refunds are provided.
• The one-time setup fee is non-refundable once development work has begun.
• Upon cancellation, Blue-CollarDigitals will provide a full export of the client's data and content. Continued hosting or access to the live application is not guaranteed beyond the final paid billing cycle unless otherwise agreed in writing.

4. Lead Capture & Anti-Spam Protection

Our intake form is protected by security validation logic (including invisible honeypot parameters) designed to reject malicious automated bot traffic. You agree to submit accurate, non-misleading contact information. Submitting fraudulent entries or attempting to inject SQL code or scripts via form fields is strictly prohibited and will be logged and blocked automatically.

5. Intellectual Property

Unless otherwise specified, all branding, text descriptions, logo icons, and templates on this website are the intellectual property of Blue-CollarDigitals and are protected under Canadian copyright laws.

For clients engaged under our one-time Starter Website package, ownership of the delivered website's source code is transferred to the client upon full payment, according to the terms of the applicable written agreement.

For clients engaged under a WAaaS (Web App as a Service) subscription, the client retains full ownership of their business data and content at all times. The underlying application code, platform architecture, and infrastructure are provided as a fully managed service for the duration of the active subscription and remain the intellectual property of Blue-CollarDigitals. If a WAaaS client's subscription ends for any reason, Blue-CollarDigitals will provide a complete export of the client's data and content within a reasonable timeframe upon request.

6. Disclaimer of Warranties

This website and its static working demo prototypes are provided on an "as is" and "as available" basis. While we strive to maintain high uptime and secure data handling, we make no representations or warranties, express or implied, regarding the continuous operation of this site, the accuracy of placeholders, or the performance of software products when hosted outside our dedicated retainers.

7. Limitation of Liability

To the maximum extent permitted by law, Blue-CollarDigitals shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of, or inability to use, this website, including data losses, server down-times, or email transmission delays.

8. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the province of British Columbia, Canada, without regard to its conflict of law principles. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of British Columbia.

9. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes take effect immediately upon their publication on this page. Your continued use of the website following changes constitutes your acceptance of the updated terms.
